These Terms and Conditions form a contract between the customer (you) and LOOD PTY LTD  ACN: 145 736 447 and apply to the ordering, purchase, fulfilment and delivery of goods from www.lood.com.au.

Please read these Terms and Conditions carefully before placing your order with LOOD PTY LTD as these Terms and Conditions contain important information about the ordering, processing, fulfillment and delivery of goods, including limitations of liability.

Importantly, this means that if you are buying products from this site:

Once you place an order, you have 24 hours to cancel. After 24 hours you will need to take advantage of our Cancellation/Returns section of our terms and conditions.

You own the products once we hand them to the delivery agent.

You have rights as a consumer under Australian national and State laws that we cannot (and won’t) avoid. However, any liability that we are legally allowed to exclude, is excluded.

Your purchase is regarded as occurring in Melbourne, Australia where our operation is based, and these terms are governed by Victorian Consumer Law.

We may amend or update these terms at any time by posting changes at this Website, without giving notice to you. By continuing to use this Website, you agree to those changes or updates to these terms.

Any content (e.g. competition entries) you submit on the Website that isn’t personal information (see our Privacy statement) will be owned by us.

  • This page (together with documents referred to on it) tells you the terms of use on which you may make use of our Website (lood.com.au). Please read these terms of use carefully before you start to use the site.

    By using or accessing our site, you indicate that you have read, understood and accept these terms of use and that you agree to abide by them. We encourage you to read these terms of use, and consult our FAQ section if you have any particular questions in relation to browsing and shopping online with us.

  • We are the owner or the licensee of all intellectual property rights (including, without limitation, trademarks and copyright) in our site, and in the material published on it (including, without limitation, its look and feel, brands, logos and trademarks, information, graphics, photographs, content, images, sounds, video, audio, text, layout, logos, button icons and the compilation and organisation thereof, and all intellectual property rights contained therein). Those works are protected by intellectual property laws around the world. All such rights are reserved.

    You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any content separately from any accompanying text.     Without limitation to the foregoing, we acknowledge that the laws in certain jurisdictions including Australia may imply warranties and conditions or impose obligations on the supply of goods and services through or by means of our site which cannot be excluded, restricted or modified except to a limited extent. If any such laws apply, then to the fullest extent permitted by the law of the relevant jurisdiction, and in the case of Australia to the extent permitted by the Competition and Consumer Act 2010 (Cth), our liability is limited and if any liability remains it will be limited to any one or more of the following in our sole discretion in the case of any goods, the replacement or repair of the goods, or the supply of equivalent goods, or the payment of the cost of repairing or replacing the goods or supplying equivalent goods; and in the case of any services, the supply of the services again or the payment of the cost of having the services supplied again.

    Without limitation to the foregoing, you agree that in no event shall our maximum aggregate liability exceed one hundred dollars (AUD$100.00). You agree to indemnify us, our directors, employees and representatives from and against all actions, claims, suits, demands, damages, liabilities or costs (including legal costs) arising from, or which is directly or indirectly related to the use of our site, or any other products or services accessed via our site.

  • You must not misuse our site by knowingly introducing viruses, trojans or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.

     We are not liable for any loss or damage caused by a virus, system failures or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it. We always recommend all Internet users ensure they have up to date virus checking software installed.

  • LOOD PTY LTD is bound by the Privacy Act 1988 (Australia) and is committed to respecting your privacy. This section of our terms and conditions outlines how and when personal information is collected, stored and distributed by LOOD PTY LTD

    LOOD PTY LTD uses Stripe for its online credit card transactions. Stripe processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. All online credit card transactions performed on this site using Stripe are secured payments.

    Payments are fully automated with an immediate response. Your complete credit card number cannot be viewed by LOOD PTY LTD or any outside party. All card numbers are encrypted at rest with AES-256. Decryption keys are stored on separate machines.

    For the purposes of processing your order, we collect the following information:

    Your name, address, telephone number, email address and username, information about the products or services you order or enquire about (including how they are used), method of payment and any information required for user authentication processes, or any other information relating to you that you provide to us (including information you provide in surveys and competition forms and through our other promotional activities).

    The personal information we collect is generally supplied directly by you through our Website. We also receive and store certain types of information through the use of 'Cookies', when you interact with LOOD PTY LTD via the Internet. Cookies are alphanumeric identifiers that are placed on your computer's hard drive through your web browser. Most Internet browsers are pre-set to accept cookies. If you prefer not to receive cookies, you can adjust your Internet browser to disable or to warn you when cookies are used. We recommend that you leave your cookies enabled as they allow our systems to recognise your browser and provide quicker and easier use of our Website.

  • Prices shown on the Site are in Australian Dollars (AUD).

    Prices are subject to change effective immediately upon posting to our Site or other form of notification.

    While we take care to ensure that all prices quoted on our Site are accurate, errors may occur. If we discover an error in the price of any product you have ordered, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it. If we are unable to contact you, the order will be treated as cancelled and if you have already paid for the product you will receive a full refund. We are under no obligation to sell the product to you at the incorrect (lower) price (even after we have sent you an order confirmation) if the pricing error is an obvious typographical or arithmetical inaccuracy and could have reasonably been recognised by you as such.

    Where you access the website from an IP address located within Australia, Prices displayed will include GST. Where you access the website from an IP address located outside Australia, all Prices will be stated in Australian Dollars and are exclusive of all Tax which may be payable in relation to your order. You are liable to pay all such Tax, including (for New Zealand customers) GST.

    Where you choose for an Estimated Price to be displayed in an alternate currency as indicated by the “$”, this is provided to you as an estimate of the Price you will pay in that currency excluding any applicable Tax which may be payable in relation to your order.

    LOOD PTY LTD reserves the right to change or alter prices of goods on the Website without notice to you, unless you have already submitted an Order at a stipulated Price, in which case there will be no change or alteration in the Price (provided your Order is not affected by an obvious pricing error).

    In respect of any Order, we will charge you and you agree to pay:

    The Price (which is the Price at the time the Order is submitted in Australian Dollars); and the Delivery Fee (if any).

    You can pay for your Goods by any of the methods specified on the electronic Order form on the Website. When paying by credit card, you authorise LOOD PTY LTD  to debit your nominated card at the time you submit your Order. The name on the credit card used for the payment must match the name on the Order.

    You acknowledge and agree that any payment in respect of an Order must be cleared by LOOD PTY LTD before Goods which are the subject of an Order are dispatched. If your payment cannot be processed, your Order will be rejected in accordance with these Terms and Conditions and you will be notified of this on the Website. In relation to credit cards, you should contact your card issuer in the first instance to try to resolve any problem concerning the use of your credit card, or use an alternative payment method in order to continue with your Order.

    In paying or attempting to pay for the Goods, you agree that you have not engaged in any fraudulent conduct or contravened any law.

    You will receive an invoice by email once payment in respect of your Order has been processed. LOOD PTY LTD uses an encrypted payment gateway and security certificate to secure payments. Whilst we take all reasonable precautions, we cannot guarantee the security of any transaction.

  • When getting into contact about the possibility of a return, refund or replacement, please email us at sales@lood.com.au

    Please include the following information in your email to us:

    Your email and the name provided in the original order.

    The order number in the subject line.

    Clear detail/explanation on why you are requesting a return, refund or replacement.

    For major problems with an item, please include photographic evidence.

    Upon receiving and inspection of your return, we will contact you about next steps. If determined to be in good condition, ‘like new’ a refund for the price of the product returned to your original payment method.

  • We may terminate a Contract if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made. We will refund any money received from you using the same method originally used by you to pay for the product. If the refund transaction fails, we will advise you of this and make arrangements to process the refund via a different method.

    If you wish to cancel your Order this needs to be done within 24 hours of placing, please contact us by email sales@lood.com.au. Once an Order has been processed for dispatch, it cannot be cancelled, and the item must instead be returned to us in accordance with the Returns section of our terms and conditions.

  • LOOD PTY LTD does not offer a refund if you change your mind or decide you do not like the goods or have no use for the goods.

  • You as a consumer are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or replaced if the goods fail to be of acceptable quality and the failure does not mount to a major failure. If there is a major failure with a product you have received from us, you are entitled to an exchange or refund under the following circumstances.

    The item has a problem that would have stopped someone from purchasing the product if they had known about it before their purchase, the item is unsafe for use, the item is clearly different to the product we have advertised on our online store or in-person, or if the item does not do what we have claimed it can do.

    If an item does not have a major problem, we will be happy to repair the product within a reasonable timeframe, or we can provide a refund or replacement item instead this is at LOOD PTY LTD discretion. Please note however that LOOD PTY LTD is not required by law to provide a refund or replacement for change of mind related issues.

    While we make the attempt to ensure goods arrived in undamaged condition, occasionally this does not happen. You must contact us within 48 hours of receiving goods via email to sales@lood.com.au .

    If you have received a product with a defect, please contact us as soon as possible so we can guide you through the returns process and help resolve the problem as swiftly as possible. To assist the return process, you may be required to send us images of the damage, defect, or fault for preliminary assessment. You may be asked to provide further information to support your claim to assist us with our assessment of the goods.

    If the product is confirmed to have a defect, we will replace or refund the price of the product to your original payment method, as appropriate. If the product is confirmed to have a major defect, you are entitled to elect whether you want us to replace or refund the price of the product to your original payment method. If the product is found not to have a defect, deemed out of warranty, or you otherwise do not have a remedy for a failure to comply with the consumer guarantees under the Australian Consumer Law, we will contact you to determine whether you want us to dispose of the product or return the product to you at your expense.

    Please note some products are handmade and will differ slightly from images on the website.

  • LOOD PTY LTD provides a warranty of 12 months for all products.

    LOOD PTY LTD warranty covers for the replacement or exchange of any product that has a manufacturing or material defect that is not the result of normal wear and tear, or a natural characteristic of the material used. This warranty is not transferrable and does not cover products used for commercial purposes.
